2. Copyright Ownership of Captured Media
Unless explicitly agreed in writing before filming:

All video footage, photographs, and related media captured by Top Drone remain the intellectual property of Top Drone.

We reserve the right to use captured media for marketing, portfolio display, advertising, social media, and future commercial use.

If a client requires full copyright ownership, this must be agreed in writing before filming. A copyright transfer fee will apply.
Under the Irish Copyright and Related Rights Act 2000, copyright cannot be transferred without a written agreement.
3. GDPR & Personal Data Protection
Top Drone complies fully with the General Data Protection Regulation (GDPR) and all Irish/EU data privacy laws.
We collect only the personal information required for project delivery, communication, planning, and regulatory compliance.
You have the right to:

4. Weather, Wildlife & Airspace Limitations
For safety and legal compliance, Top Drone does not fly when conditions pose a risk to people, property, or aircraft.
4.1 Weather Restrictions
We do not fly in:

High winds beyond aircraft safety limits

Rain, drizzle, heavy mist, or low-visibility conditions
-
Snow, ice, frost, or extreme temperatures
If unsafe weather is present, flights will be postponed or rescheduled.
4.2 Wildlife Restrictions
We do not operate:

Around aggressive birds (e.g., seagulls)
-
Near nesting grounds or protected wildlife
-
In areas where disturbance to wildlife may occur
The pilot will always prioritise wildlife protection.
4.3 Protected & Restricted Areas
We cannot fly:

In restricted or controlled airspace without approval

Directly over crowds or gatherings of people
-
In National Parks or protected zones without permits
-
Near airports, emergency scenes, or high-security facilities without approval
Permissions are requested when possible, but approval is not guaranteed.
5. Liability for Loss or Damage
Top Drone is not liable for:

Loss or damage to prints or digital media once dispatched

Courier or postal issues
-
Delays caused by weather, permissions, or regulatory restrictions
-
Any indirect or consequential financial loss
All aerial work is covered by public liability insurance.
6. Delivery Address
You are responsible for providing a correct delivery address.
We cannot accept liability for lost or damaged items caused by incorrect address details or missed deliveries.
7. Product Finish & Longevity
Colour and print quality may vary due to:

Differences between screens and print
-
Exposure to heat, humidity, and sunlight
-
Environmental conditions beyond our control
No guarantee of product lifespan can be given.
8. Cancellations
8.1 Filming & Photography Services
Cancellations must be made at least 5 days before the scheduled date.
Cancellations within 3 days may incur a fee.
Weather postponements are free for jobs under 161km (one way). For jobs 161km+ or requiring overnight stays, a non-refundable deposit (minimum 30%) is required to cover travel and lost opportunity. If we postpone due to weather, we’ll retain the deposit, and the balance is due on the rescheduled date.
All payments made for permits, applications, or travel expenses are non-refundable.
8.2 Print Orders
Custom prints cannot be cancelled once production has begun.
Returns are only accepted where required by EU distance selling laws.
Please note that colours displayed on your screen (phone, tablet or computer monitor) may differ from the final printed colours. This is due to variations in screen calibration, display settings, and the printing process used by our print partner. We cannot guarantee an exact colour match between what you see on your device and the finished print.
9. Discounts & Promotions
Discount codes and promotions:

Top Drone is not liable for:

Inaccurate or out-of-date content

The laws of Ireland apply, and disputes fall under Irish court jurisdiction.
11. Safety & Operational Control
Top Drone follows strict safety procedures. The pilot in command has full authority over all flight operations.
11.1 Situations Where We Will NOT Fly
We will not fly if:

Weather conditions pose a safety risk

Wildlife is aggressive or endangered

Airspace permissions are not granted
-
The environment is unsafe for the equipment or crew
11.2 Protection of Crew Safety
Top Drone will immediately stop operations and may cancel a project entirely if:

The pilot or crew experiences verbal abuse, intimidation, or harassment
-
There is any physical threat, aggression, or hostile behaviour
-
The location is deemed unsafe, unstable, or poses a security risk
-
Members of the public interfere with operations
In such cases:

The client may be charged a call-out fee
-
No refund will be provided for work already performed
-
Safety will always override project deadlines or expectations
11.3 Final Authority
The pilot’s judgment is final.
If Top Drone deems any operation unsafe, illegal, or non-compliant, it will not proceed.
